Terms
and Conditions of ILS accounts
These
rules and regulations are designed for mutual protection and understanding of
Internet services. Using services provided by Internet Lake Simcoe is automatically
subject to these Terms and Conditions.
Internet Lake Simcoe Ltd.
reserves the right to terminate any account if the account is being used in
violation of these policies, and we reserve the right to prohibit activities
that, in our judgment, have the potential to damage other customers or our
service.
1. Account responsibility: Internet Lake Simcoe Family Package and Personal
Business Package dial-up accounts are meant for the personal use of the owner
(user) of the account and under his/hers supervision for members of his/hers
immediate household. The account owner
is responsible for all charges and potential legal consequences incurred by the
account. The account owner must notify Internet Lake Simcoe immediately if they
suspect unauthorized use of their account.
2. Distribution, sharing or
reselling of services: Internet Lake
Simcoe accounts are end user consumer products. The owner of the account may
not in any way redistribute internet access, bandwidth, server space or server
services to third parties for monetary or non-monetary purposes. Internet Lake
Simcoe network resources may not be used to share, redistribute or resell third
party services or products. This includes copyrighted multimedia products such
as audio, video or graphics, which may be freely available on the Internet.
3. Publishing:
Internet Lake Simcoe Ltd. is not responsible of any copyright violations
or illegal material published through its server services, but will co-operate
and make information available to legal authorities regarding publishing
copyrighted or illegal contents. Internet Lake Simcoe Ltd. will not
allow pornographic, violent or offensive material published on its servers,
even if technically legal, and reserves the right to delete any such material
without warning.
4. Dial-up accounts: Dial-up accounts with unlimited connection time are not dedicated full-time connections. Use of programs that emulate network action is forbidden and will result in immediate disconnecting and suspending the account.
All users
of the network are requested to divide
their prime-time (7:30 pm - 11:30 pm) usage to two hour sessions with at least ten-minute breaks in between. To evenly
distribute the network resources, the network administrators will interrupt
lengthy sessions if necessary.
All
dial-up accounts are single user accounts. An attempt to dial in with the same
username and password twice or more will be considered unauthorized use and for
the protection for your account, the administrators will without warning
suspend the account.
5. Timed
dial-up accounts: All
accounts involving a usage time limit will be charged $1.00 per hour for the
time exceeding the time limit. The only valid time account is the record
created by the Internet Lake Simcoe radius server at the end of each calendar
month. The account owner is responsible of monitoring the usage time of his or
hers household or business, and will not be reminded or warned when the time
limit is about to be exceeded.
Usage
below the time limit will not be refunded and cannot be transferred to the next
invoicing cycle.
If the user wishes to change the type of the
account to a higher or lower usage time package, he or she is required to do so
by filling and signing the New Account Application form at the Internet Lake
Simcoe office. The change will be applied to the users next invoicing cycle.
6. High-speed service
accounts: High speed
internet connections offered by Internet Lake Simcoe Ltd. using Local Area
Network (LAN), Digital Subscriber Line (DSL) or Wireless technologies may not
be used for more than one file transfer or data stream connection
simultaneously. The administrators of the Internet Lake Simcoe network will
protect the common network from high bandwidth automated network traffic by
restricting service types, access bandwidth or disconnecting the problem
device.
Owners of
the High Speed service accounts may network the number of computers specified
in their individual Account Application Form. These computers must be located
in the immediate household or office environment and must be under supervision
of the owner of the account. The Internet Lake Simcoe network administrators
may probe the network to see how may network devices are connected to each
high-speed service device.
Internet Lake Simcoe Ltd does not buy back or
refund high-speed equipment purchased or leased through Internet Lake Simcoe
Ltd. Equipment purchased through Internet Lake Simcoe will be sent to the
manufacturer for warranty repairs if applicable.
7. Equipment: Services of Internet Lake Simcoe
can be accessed with a personal computer running different up-to-date operating
systems. Consult our personnel for the compatibility of your equipment before
opening your account. Services can be accessed only through a fully functional
phone line, properly installed, non-conflicting software and hardware.
Internet
Lake Simcoe is not responsible of the condition of client equipment before,
during, or after the duration of the account.
Internet Lake Simcoe Ltd does not buy back or
refund equipment purchased or leased through Internet Lake Simcoe Ltd.
Equipment purchased through Internet Lake Simcoe will be sent to the
manufacturer for warranty repairs if applicable.
8. Technical support: Internet Lake Simcoe Ltd. provides free
of charge expert technical support to its customers regarding Internet
connectivity by mainstream operating systems such as Microsoft Windows by
telephone or Internet mail. Since the accuracy of various technical situations
cannot be verified, the Technical Support is considered advisory only, and
Internet Lake Simcoe Ltd. is not responsible in any way of any situation
resulting of these consultations.
Internet
Lake Simcoe is not obligated to provide assistance for general computer
software or hardware problems.
Due to
liability situations, Internet Lake Simcoe Ltd. customer service agents, during
their office hours, at company premises, will not physically touch any customer
equipment.
Internet
Lake Simcoe personnel may recommend services of third party technicians or
computer stores to account users experiencing technical difficulties. Internet
Lake Simcoe Ltd. does not in any way guarantee, warrant or assume
responsibility of services provided by third parties.
9. Software: Internet Lake Simcoe makes certain
software available to customers.
This
software can be Internet freeware or propriety software especially written for
Internet Lake Simcoe. Modifying, copying, reproducing, licensing or
sublicensing these programs is forbidden. Observe license agreements separately
on each program.
10. Contents published on
the Internet: Internet
Lake Simcoe does not filter or censor contents on the Internet, and is not
responsible of any contents or communications of the worldwide network.
Internet
Lake Simcoe Ltd. warns its customers, that it may be possible to obtain,
willingly or unknowingly, illegal or offensive material, or software harmful to
personal computers, from the Internet. We recommend using protective software
in all client computers.
Please
note that several Internet applications enable parents to block unwanted
material.
By
requesting an Internet Lake Simcoe account, you waive all liability on the part
of Internet Lake Simcoe Ltd. regarding the correctness or fitness of any
material in text, graphic or binary form.
11. Commercial and bulk
mailing: Internet Lake
Simcoe does not permit commercial
mailings or bulk mailings. Using mailing lists to send binary
attachments is forbidden. Internet Lake Simcoe does not permit posting of
commercial messages to Usenet news groups where the messages are irrelevant to
the subject matter, or where these messages are posted in bulk to many news
groups.
12. Chain letters: You may not use your Internet Lake
Simcoe account to send, copy, or forward chain letters.
13. Security: Any attempt to intrude servers, personal computers or any devices
on the Internet is forbidden and will result in criminal charges.
This includes e.g. scanning TCP/IP ports, spreading harmful software, such as
viruses or trojans, attempts to solve passwords, etc. The network
administrators use automated software to monitor network traffic for illegal
activity.
14. Mail: The Internet Lake Simcoe mail server
is programmed to send and deliver POP3 and SMTP electronic mail. Moderate size
(less than 5 megabytes) file attachments are allowed but not recommended.
The
mailbox size is limited to 5 megabytes. Network users are requested to check
their mail at least once in two weeks.
Using
your Internet Lake Simcoe account under false identity will be considered
criminal act and reported to authorities.
15. Mail privacy: Communication on the Internet may
not be completely private or reliable. The risk of someone intercepting and
reading your mail is considered to be low, about the same risk as someone
intercepting and listening to phone calls made with cellular or portable
phones. Internet Lake Simcoe Ltd. will not read the users' mail under any
circumstances; however, once the plain text mail is out on the public network
we cannot warrant the privacy of the communication. In rare occurrences, and
only when necessary, if your account is experiencing a mail problem, a
potential computer virus etc., the administrators are allowed to remove mail
messages.
16. Service outages: Internet Lake Simcoe Ltd. makes
every attempt possible to ensure that the service is available 24 hours a day,
365 days a year. However, Internet Lake Simcoe Ltd. does not warrant
uninterrupted working of the service. Internet Lake Simcoe Ltd. reserves the
right to bring down the system occasionally for maintenance purposes.
Whenever
possible, Internet Lake Simcoe will make information about service outages,
changes and upgrades available on its web site http://www.ils.net/. All users
are recommended to keep this site as their web browser home page.
In
addition, events beyond our control (such as, but not limited to, interruptions
or limitations of telephone or hydro services, interruptions of communications
with remote networks) may cause the service to be unavailable for periods of
time. Internet Lake Simcoe Ltd. assumes
no liability for interruption of services in such cases. Internet downtime is
not refundable.
17. Account renewals: Each Internet Lake Simcoe Account
is renewed when the invoice for a new access period is issued.
Each
Internet Lake Simcoe Ltd. account will be invoiced to Internet Lake Simcoe
Internet mail address of the account owner monthly or quarterly as arranged at
the time of opening the account. Internet Lake Simcoe Ltd. is not obligated to
deliver the invoice by any other means than its own Internet Mail system.
The
invoice is due upon receipt, overdue 30 days after the date of the invoice.
The
Internet Lake Simcoe Account will be renewed and invoiced regardless of the
amount or lack of usage, until the owner of the account, in person, by
telephone, email or fax, cancels the account. If the account is overdue, ILS is
not responsible of providing the service.
The account will be invoiced to the day of disconnection.
Non-responding, cancelled overdue accounts will be sent to
a registered collection agency. After the account is transferred to the care of
the collection agency, the owner of the overdue account will have to make to
arrangements directly with the collection officer to settle the account.
Changing the account to a different type of service
involves signing the “New Account Approval” form and the $9.95 activation fee.
18. Service invoiced: Internet Lake Simcoe Ltd. service
is access to the Internet. The access is provided at the time when the account
is opened or renewed. The access may be in the form of limited time Internet
access, unlimited time Internet access, dedicated full time high-speed Internet
access or publishing access using server services. The service can be obtained
for minimum amount of one month at the time. The owner of the account has the
option to use or not to use the access provided.
19. Terms: Due to the constantly changing and open nature of Internet
Services worldwide, Internet Lake Simcoe Ltd, in order to protect common interest
of Internet users, may change these Terms and Conditions without notice. Each
renewal of the account takes place under the current Terms and Conditions,
which may be different from the document published or distributed at the time
of opening the account. For this reason all account owners are advised to view
the current Terms and Conditions at the time of renewal of the account. The
current version is available as a paper copy at the Internet Lake Simcoe Ltd.
